The undersigned Owner grants Jersey Cape Realty, Inc. (“Broker”) permission to list for rent the property described below under the terms and conditions as written here, and under any other terms and conditions to which Owner and Broker may otherwise agree in writing. Owner is aware and acknowledges that the information in this Authorization shall be utilized and relied upon by Broker for the purpose of soliciting, and advertising for, tenants.

AS OWNER, YOU HAVE THE RIGHT, INDIVIDUALLY, TO REACH AN AGREEMENT ON ANY FEE, COMMISSION, OR OTHER VALUABLE CONSIDERATION WITH ANY BROKER. NO FEE, COMMISSION, OR OTHER VALUABLE CONSIDERATION HAS BEEN FIXED BY ANY GOVERNMENT AUTHORITY OR BY ANY TRADE ASSOCIATION OR MULTIPLE LISTING SERVICE.
Owner agrees to pay Broker a professional fee of 12% on any rental lease secured by Broker. This professional fee shall be deemed to be fully earned by Broker upon the execution of a lease by and between Owner and tenant. All rental payments are to be collected by Broker, and Broker's fee is to be deducted from each payment as it is received. In the event a lease is extended or renewed, or if Owner leases or rents, in any successive year, the same premises or another rental premises owned by Owner to a tenant previously secured by Broker, then in each such instance Owner agrees to, and shall, pay Broker the professional fee stated above. OWNER UNDERSTANDS AND AGREES THAT THIS AUTHORIZATION IS INTENDED SOLELY FOR THE PURPOSE OF SECURING TENANTS, FOR WHICH THE PROFESSIONAL FEE IS CONSIDERED EARNED BY, AND IS DUE AND PAYABLE TO, BROKER, AND DOES NOT INCLUDE PROPERTY MANAGEMENT SERVICES. PROPERTY INSPECTIONS, FOR WHICH OWNER ACCEPTS FULL AND EXCLUSIVE RESPONSIBILITY, ARE ALSO NOT INCLUDED IN BROKER’S SERVICES UNDER THIS AUTHORIZATION.
Owner further agrees as follows:
1. To make inspections after each rental period to insure the property’s safe, clean, and sanitary condition.
2. To keep and maintain, in good working condition and repair in each rental unit, an adequate number of smoke detectors, fire extinguishers and any other fire protection equipment, in accordance with New Jersey Law.
3. To maintain adequate liability and property damage insurance, naming Broker as an additional named insured, and to indemnify and hold harmless Broker, its agents, servants and employees, from and against any and all actions, claims, loss, liability, cost and expense (including payment of reasonable attorneys’ and experts’ fees), (a) arising in any way from any personal injury or property damage occurring in, on or about Owner's property, and (b) arising in any way out of the use or occupancy of the rental premises.
4. To maintain a current Certificate of Occupancy and a current "Mercantile License," if such a license is required.
5. To be solely and exclusively responsible and accountable for the performance of all leases.
6. To notify Broker immediately should the rental premises become unavailable for any reason whatsoever.
7. Owner must deliver to tenant, within seven (7) days of the date of lease expiration, with a contemporaneous copy delivered to Broker, written notice of any amounts which Owner intends to deduct from the security deposit and the cleaning deposit, in ACCORDANCE WITH THE TERMS OF THE LEASE AND SUPPORTED BY A CLEAR AND DETAILED, WRITTEN EXPLANATION. If timely notification is not strictly received from Owner as set forth above, then all security and cleaning deposit moneys will be promptly returned in full by Broker to tenant. Additionally, Owner must provide Broker, immediately upon check-out or other vacation of the rental premises by tenant, with a clear and detailed, written explanation, to include and to be supported by pictures, for any claims against damage protection insurance, when applicable, with supporting invoices for repair or replacement to follow within seven (7) days. If timely written notification is not received by tenant and Broker, as applicable, from Owner for any of the above deductions or claims, then no such deduction or claim shall be considered as made.
8. Broker will deposit, in an interest bearing trust account, any damage, cleaning and security deposits received on long-term leases (defined as those that extend for a period of one hundred twenty (120) days or longer). The interest bearing account will be maintained in a Federally Chartered Bank, Savings Bank or Savings & Loan Association within the State of New Jersey.
9. Owner agrees that Broker may accept, on behalf of Owner, credit card payments for short-term leases (defined as those for a period less than one hundred twenty (120) days). Owner is aware of the possibility of credit card “charge backs” and accepts that risk. Initial
